Simulator Terms

These terms govern use of the public-beta Generation Profile Simulator and any browser-generated report or shared result.

1. Planning tool only

The simulator is an illustrative screening and research tool. It is not an engineering design, bankable energy assessment, performance guarantee, tariff analysis, interconnection study, PPA quote, financial model, investment advice, offer or project approval.

2. Model limitations

Results depend on user inputs, synthetic profiles, idealized geometry and simplified operating logic. The public beta does not fully model exact MODMEC geometry, site horizon and near-shading, soiling, clipping, curtailment, availability, stow events, degradation, battery aging, complete tariffs, CAPEX/OPEX, constructability or measured pilot calibration.

3. Your inputs and responsibilities

You are responsible for the accuracy, authorization and suitability of all inputs. Do not submit confidential, export-controlled, personal or restricted information. Before making an engineering, procurement, construction, financing, interconnection or operating decision, obtain appropriate independent professional review using verified site data.

4. Reports and shared results

A browser-generated PDF is not signed, certified or approved by an engineer, utility, lender, customer, site operator, regulator or data provider. You may use it for internal screening and discussion if all disclaimers and attribution remain visible. You may not present it as bankable, approved, independently validated or as evidence of measured MODMEC commercial performance.

5. Energy-value and market assumptions

User-entered values and MODMEC presets are synthetic screening assumptions. They are not utility tariffs, avoided-cost rates, PPA offers, quotations, electricity-bill savings, revenue or profit. Named locations identify comparison markets only and do not indicate a customer relationship, project, available interconnection or site feasibility.

6. Third-party data and non-endorsement

Annual weather analysis may use European Commission PVGIS data. MODMEC performs additional calculations and changes. PVGIS and every referenced utility, customer category, site operator and data provider are independent of MODMEC and have not reviewed, approved, sponsored or endorsed the model or its output.

7. Intellectual property and permitted use

MODMEC and its licensors retain rights in the simulator, branding, model implementation and materials. These terms grant only a limited, revocable right to use the public beta for lawful evaluation. They do not grant a patent, trademark, source-code, commercial-deployment or derivative-model license.

8. Prohibited conduct

You may not interfere with security, automate abusive requests, remove legal notices, misrepresent output, imply unauthorized affiliation, or use the service or results unlawfully. Public accessibility does not authorize bulk extraction or publication of misleading comparisons.

9. Disclaimers and liability

To the maximum extent permitted by law, the simulator and outputs are provided "as is" and "as available" without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation. MODMEC is not liable for indirect, incidental, special, consequential, exemplary or lost-profit damages arising from use or reliance. Nothing excludes liability that applicable law does not permit to be excluded.

10. Changes and contact

MODMEC may change or discontinue the public beta and may update these terms. The effective date identifies the current version. Questions may be sent to office@modmec.com.

These terms reduce obvious public-beta risks but should be reviewed by qualified U.S. counsel before the simulator is used in a paid study, utility submission, investor package, procurement decision or pilot contract.
